RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT

BASE JUMPING COULD CAUSE SERIOUS INJURY OR EVEN DEATH

IN CONSIDERATION of being permitted to BASE Jump at Bridge Day 2024, and related activities, hereinafter collectively referred to as “parachuting activities”.

PARTIES INCLUDED. I understand that this Agreement, Release of Liability, and Assumption of Risk includes the Bridge Day Commission severally and individually, The Fayette Chamber of Commerce along with its members, agents, owners, employees, contractors, and volunteers; West Virginia State Highway Administration; the National Park Service; Dragan Diversified, Inc.; Mark Kissner, Miscellaneous Metals, Inc; Fayette County West Virginia and its agents, employees, contractors, and volunteers; the Town of Fayetteville and its agents, employees, contractors, and volunteers; any manufacturers and/or owners of equipment used; anyone working with or on behalf of Bridge Day 2024; and anyone involved in my jumping and “parachute activities”, hereinafter collectively referred to in this Release of Liability, and Assumption of Risk Agreement.

RISKS CONTEMPLATED. This Agreement is made in contemplation of all “parachuting activities”, included but not limited to jumping from the New River Gorge Bridge, parachute jumping, flying and related activities, the exit, freefall, time under canopy, other parachutists in concurrent flight, obstacles in flight, the parachute landing, rescue operations, whether on any part of the bridge, in the gorge, or in the water of the New River during Bridge Day 2024.

RELEASE FROM LIABILITY. I hereby release all parties stated in Paragraph 1, PARTIES INCLUDED, from any and all liability, claims, demands, or action that I may have for injuries or death arising out of my participation in “parachuting activities” even if caused by negligence or other fault of any parties listed in Paragraph 1, “Parties Included” or any other party included in this Agreement.

RELEASE FROM PERSONAL PROPERTY CLAIMS. I hereby release all parties named in Paragraph 1., above, from any and all liability, claims, demands, and/or action that I may have arising from any damages to or loss of any personal property while attending and participating in jumping/parachuting activities at Bridge Day 2024 or, whether said property was intentionally or accidentally left at any event locale.

COVENANT NOT TO SUE. I further agree that I, or any heir, WILL NOT SUE OR MAKE CLAIM against any party stated in Paragraph 1, PARTIES INCLUDED, for damages, death, or other losses sustained as a result of my participation in “parachuting activities”, even if caused by negligence or other fault of any other party included in this agreement.

INDEMNIFICATION AND HOLD HARMLESS. I also agree to INDEMNITY AND HOLD ALL PARTIES INCLUDED, HARMLESS from all claims judgments and costs, including but not limited to attorney’s fees, and to reimburse them from any expenses whatsoever incurred in connection with any action brought as a result of my participation in “parachuting activities."

Terms & Conditions:

• All Bridge Day participants are expected to be respectful of other participants and conduct themselves in a collaborative and polite manner. The New River Gorge Bridge Day Commission strictly prohibits participants in all BASE jumping activities from engaging in behavior that is disruptive, aggressive, violent, obstructive, or that is contrary to the overall family friendly atmosphere of this event. Additionally, BASE jumpers are prohibited from engaging in willful misconduct or recklessness while participating in BASE activities.  Should a BASE jumper participate in such activities, the New River Gorge Bridge Day Commission reserves the right to prohibit the offending jumper from participating in all future Bridge Day BASE jumping activities.

• The New River Gorge Bridge Day Commission strictly prohibits participants in all BASE-jumping activities from posting footage from their jumps on social media for the purpose of personal gain or profit.  In the event that a BASE jumper participates in such activities, the New River Gorge Bridge Day Commission reserves the right to prohibit the offending jumper from participating in all future Bridge Day BASE jumping activities.
• By registering for an Event, you agree that the Fayette County Chamber of Commerce and its designees shall have the sole discretion to interpret or assess any behavior or conduct of a participant either reported or witnessed at Bridge Day, and to take any and all necessary actions to deal with actions that may violate these terms and conditions, including but not limited to cancelling or terminating an attendee's right to attend or participate in any current or future Bridge Day.
